This Web Site (and any other site accessed through this site) andthe services provided therein are only available to users seekingemployment ("Jobseekers") or users seeking employees or advertisers("Employers") and are subject to the Terms and Conditions which are setout belore binding upon you. Inpros Marketing Systems Company Limited("the Company") may revise the Terms and Conditions at anytimew. If you do not accept the Terms and Conditions, please do notuse this Web Site. Upon your acceptance of the Terms and Conditions,they a withoutnotice to you. Your access the Company's Web Site and its services willbe terminated upon your notice to the Company that any change isunacceptable otherwise your continued use will constitute youracceptance of all changes and they will be binding upon you.

  1. Definitions

    The following expressions shall have the following meanings in this Agreement:-
    (1) "Jobseekers" means users seeking employment.
    (2) "Employers" means users seeking employees or advertisers.
    (3) "the Company" means Inpros Marketing System Co., Ltd.
    (4) "Website" means the internet web site of Inpros Marketing Systems Co., Ltd. at http://thaijobbox.co.th
    (5) "Service" means the services to be provided by Inpros Co.,Ltd tothe Jobseekers at or through the Website including the following andsuch services as Inpros Co., Ltd. may include on the Website from timeto time.

  2. Acceptable Web Site Uses

    * Specific Uses - Jobseekers

    Jobseekers agree that they will only use the Company's Web Sites (andany other sites accessed through them) for lawful purposes and to seekemployment. Jobseekers may send their resume directly to any Employerwho advertises on or through the Company Web Sites. Alternatively theJobseeker may send his resume to the Company through the Company's WebSites in reply to any job advertisement. In such event the Jobseeker'sresume will also remain active on the Company's Web Sites for apredetermined period and, unless the Jobseeker chooses to delete it, itwill thereafter be stored in the Company's Database at the Jobseeker'sown risk. The Company also reserves the right to edit any Jobseeker'sresume as it sees fit. Jobseekers acknowledge and agree to theCompany's practice of charging Employers a fee for access to theCompany's web sites, Database and to the Jobseeker's resumes anddetails. The Jobseekers also recognizes that he has no claims to anysuch fees received by the Company. The Company will not release theJobseeker's personal data to any potential employer without his/herpermission but the Company will release the Jobseeker's brief resume(without his name and address) to third parties through the use of theCompany's search engine or any other means. However, Jobseekers doagree that the Company and its associated companies may use theJobseeker's personal data for marketing purposes. Further, the Companywill not be responsible or held liable in any way if any Employer,whether in Thailand or elsewhere, should use the Jobseeker's personaldata for any other use other than for obtaining potential employees.

    Jobseekers accept that personal data given to Employers or other users are given entirely at their own risk:-
    (1) To provide goods and services by the Company, its designatedrepresentatives and/or business partners to the Jobseekers and mattersancillary thereto;
    (2) For verification and record of the Jobseekers' personal particularsincluding comparing it with information from other sources and usingthe information to communicate with Jobseekers;
    (3) To conduct statistical analysis of the users of the Company's sitesincluding the number of users, the frequency of use, profile of usersand using such analysis for the Company's business plans, theenhancement of the Company's products and services, targetedadvertisements and conveying such information in broad terms (but notinformation in relation to specific individuals) to third parties whohave or propose to have business dealings with the Company;
    (4) To send the Jobseekers information, promotions and updatesincluding marketing and advertising materials in relation to theCompany's goods and services and those of third party organizationsselected by the Company.

    * Specific Uses - Employers

    Upon payment of the Service Fee to the Company or upon acceptance ofany free trail promotion offer, the Employer will be entitled to usethe Company's Web Sites to advertise jobs vacant and/or create theirown web page on the Company's Web Site for a predetermined periodfollowing agreement of the predetermined service. The only exception isa free trial promotional offer. Employers will also be entitled toaccess the Company's Jobseekers Database but agree that all informationobtained will only be used for the purpose of obtaining potentialemployees. Employers will be solely responsible for the contents andmaterials contained in their advertisement and/or web page. The Companyreserves the right to edit any advertisement or web page as it seesfit. The Company reserves the right to change the Service Fee orinstitute new charges or fees, as it deems appropriate. In the eventthat any Employer should fail to pay the Service Fee or any other feesor changes due to the Company, the Company reserves the right tosuspend or terminate the Employer's web page or advertisement, withoutprejudice to all other rights and remedies.

  3. Prohibited Uses - Jobseekers and Employers

    Jobseekers and Employers agree not to use any of the Company's WebSites for any of the following purposes which are expressly prohibited:-
    (1) Jobseekers shall not post any non-resume information and/orincomplete, false or inaccurate resume information which is not theirown accurate resume.
    (2) Jobseekers shall not respond to any employment opportunity for anyreason other than to apply for the job advertised and Employers shallnot respond to any Jobseekers other than in connection with theirapplication for a job. Communications soliciting business for anyreason is prohibited.
    (3) All users shall not print, download, duplicate or otherwise copy oruse of any personally identifiable information about other users. Allunsolicited communications of any type to users is strictly prohibited.
    (4) All users shall not delete or revise any material posted by any other person or entity.
    (5) All users are prohibited from violating or attempting to violatethe security of the Company's Web Sites (or any other sites accessedthrough the Company's Web Sites) including, without limitation,accessing data not intended for them or logging into a server oraccount which they are not authorised to access, attempting to probe,scan or test the vulnerability of a system or network or attempting tobreach security or authentication measures without properauthorization, attempting to interfere with service to any user, hostor network or sending unsolicited e-mail, including promotions and/oradvertising of products or services. Violations of system or networksecurity may result in civil or criminal liability.
    (6) All users will not use the Company's Web Sites in order totransmit, distribute or store material in violation of any applicablelaw or regulation, or in any manner that will infringe the copyright,trademark, trade secrets or other intellectual property rights ofothers or violate the privacy or publicity or other personal rights ofothers, or that is libelous, obscene, threatening, abusive or hateful.

  4. User ID and password - Jobseekers and Employers

    (1) Jobseekers shall safeguard their own user ID and password at alltimes, and shall take all steps to prevent unauthorized use of theServices.
    (2) User IDs and password shall not be shared with any other party.
    (3) The Company reserves the right to change or re-assign user IDand/or password(s) to Jobseekers at theirs sole discretion withoutincurring any liability in relation to any party.
    (4) Jobseekers shall notify the Company immediately in the event thatsecurity is breached. Inpros Co., Ltd. shall not incur any liability inrelation to any party for any losses, damages, expenses, costs orinconvenience caused.

  5. Copyright, Trademarks etc.

    The graphics, images, editorial content and HTML on all the Company'sWeb Sites are the intellectual property of the Company and areprotected by copyright and trademark laws and may not be downloaded orotherwise duplicated without the express written permission of theCompany. Re-use of any of the foregoing is strictly prohibited and theCompany reserves all rights.

  6. Responsibility

    The Company may not monitor its Web Sites at all times but reserves theright to do so. The Company takes no responsibility whatsoever for anymaterial input by any user or others and not posted by the Company. Allusers acknowledge and agree that they are solely responsible for theform, content and accuracy of any resume, advertisement, web page ormaterial contained therein placed by them. The Company is notresponsible for the content of any other web sites linked to theCompany's Web Sites; links are provided as internet navigation toolsonly. The Company does not warrant that any resume, advertisement orweb page will be viewed by any specific number of users or that it willbe viewed by any specific user. The Company is not in anyway to beconsidered to be an agent with respect to any user use of the Company'sWeb Sites and the Company will not be responsible in any way for anydecision, for whatever reason made, made by any party seeking orposting jobs on the Company's Web Sites. THE COMPANY DOES NOT WARRANTTHAT ITS WEB SITES WILL OPERATE ERROR-FREE OR THAT ITS WEB SITES ANDITS SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL MECHANISMS. IF USE OFTHE WEB SITES OR THEIR CONTENTS RESULT IN THE NEED FOR SERVICING ORREPLACING EQUIPMENT OR DATA, BY ANY USER, THE COMPANY WILL NOTRESPONSIBLE FOR THOSE COSTS. THE COMPANY'S WEB SITES AND THEIR CONTENTSARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TOTHE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALLWARRANTIES, INCLUDING WITHOUT PREJUDICE TO THE FOREGOING, ANY INRESPECT OF MERCHANTABILITY, NON-INFERINGEMENT OF THIRD PARTY RIGHTS,FITNESS FOR PARTICULAR PURPOSE, OR ABOUT THE ACCURACY, RELIABILITYCOMPLETENESS OR TIMELINESS OF THE CONTENTS, SERVICES, SOFTWARE, TEXT,GRAPHICS AND LINKS OF THE COMPANY'S WEB SITES.

  7. Own Risk

    All USERS USE THE COMPANY'S WEB SITES AND ANY OTHER WEB SITES ACCESSEDTHROUGH IT AT ENTIRELY THEIR OWN RISK. All users are responsible fortheir own communications and are responsible for the consequences oftheir posting. The Company does not represent or guarantee thetruthfulness, accuracy or reliability of any of the communicationsposted by other users or endorses any opinions expressed by users. Anyreliance by users on material posted by other users will be at theirown risk. The Company reserves the right to expel any user and preventtheir further access to the Company's Web Sites, at any time forbreaching this Agreement or violating the law and also reserves theright to remove any material which is abusive, illegal or disruptive.

  8. Links to Other Sites

    The Company's Web Sites may contain links to third party Web Sites.These are provided solely as a convenience to you and not in any way asan endorsement by the Company of the contents on such third-party WebSites. If any user accesses any linked third party Web Sites, they doso entirely at their own risk. The Company is not responsible for thecontent of any third party Web Sites linked to its Web Sites and doesnot make any representations or warranties regarding the contents oraccuracy of materials on such third-party Web Sites. Further anymaterial or details posted in the Company Web Sites by any user may beviewed by users of other web sites linked to the Company's Web Sitesand the Company will not be responsible for any improper use by anyuser or third party from linked third party web sites of any data ormaterials posted on the Company's Web Sites.

  9. Indemnity

    All users agree to indemnify, and hold harmless the Company, itsofficers, directors, employees and agents from and against any claims,actions, demands, losses or damages arising from or resulting fromtheir use of the Company's Web Sites or their breach of the terms ofthis Agreement. The Company shall provide prompt notice of any suchclaim, suit or proceeding to the relevant user.

  10. Disclaimer

    THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS SHALL NOT BELIABLE IN ANY EVENT FOR ANY LOSSES OR DAMAGES SUFFERED BY ANY USERWHATSOEVER ARISING OR RESULTING FROM THEIR USE OR INABILITY TO USE THECOMPANY'S WEB SITES AND ITS CONTENTS.

  11. Limitation of Liability

    Without prejudice to the above, the aggregate liability by the Companyto any user for all claims arising from their use of the Company'sservices and the Company's Web Sites shall be limited to the amount ofthe existing package fee subscribed to and paid for by the user (ifany) and operative at that time.

  12. Governing Law and Jurisdiction

    This Agreement and any dispute or matter arising from or incidental toyour use of the company's Web Sites shall be governed by the laws ofThailand and both you and the Company submit to the Jurisdiction of thecourts of Thailand.
